The director of the FBI has warned that criminals and terrorists will be able to talk ‘with impunity’ if encryption goes too far.

James Comey said that anti-surveillance measures being deployed by the likes of Apple and Google will ‘inexorably affect my ability to do that job’ if they continue to expand.

He said that if the FBI cannot monitor communications then there is no doubt that it ‘will affect public safety’.

Mr Comey cited the dangers of ISIS and said that it will be harder for law enforcement agencies to stop the terrorist organisation recruiting.

His comments come as tech giants have been outdoing each other to offer their customers better encryption after the revelations about mass spying by the National Security Agency.

They also want to make users feel secure following scandals such as Celebgate, when naked photos of dozens of female celebrities were stolen from their iCloud online storage accounts.

In a blog post, Mr Comey said there was a trade-off to be had about ‘going dark’, when investigators were not able to monitor suspects.

Mr Comey said: ‘Universal strong encryption will protect all of us – our innovation, our private thoughts, and so many other things of value – from thieves of all kinds.

‘We will all have lock-boxes in our lives that only we can open and in which we can store all that is valuable to us. There are lots of good things about this.’

However he added that there were ‘many costs to this’.

The most obvious was that ‘bad people can communicate with impunity in a world of universal strong encryption’.

Mr Comey said: ‘It may be that, as a people, we decide the benefits here outweigh the costs and that there is no sensible, technically feasible way to optimize privacy and safety in this particular context, or that public safety folks will be able to do their job well enough in the world of universal strong encryption’.

Mr Comey added that he was ‘not a maniac’ when it came to privacy but that his job was ‘to keep people safe’.

He spoke out after Apple has said that it will not longer give police information on stolen iPhones or iPads because only a password will allow access to the device.

Even if law enforcement has a search warrant and it is a terrorism case, Apple will be unable to access the phone without the user’s permission.

Google has released a simple tool that allows users to set up end-to-end email encryption, which is hard to decipher and will pose a major challenge to snoopers.

Since taking up his post Mr Comey has been unafraid to speak his mind on a number of hot button topics.

In a landmark speech he said that in the US police had to acknowledge that ‘much of our history is not pretty’ and that they had to change.

The comments were the first time a director of the FBI has spoken about race at length, but the bluntness in which he spoke was surprising.

The Bureau has a complicated history with black Americans dating back to the surveillance of Dr Martin Luther King during the civil rights era.

NASA TAKES ON THE DARK NET

Nasa revealed in May that it is joining a Defense Advanced Research Projects Agency (Darpa) project to scour content on this so-called dark net.

Called Memex, it is a combination of memory and index – that not only indexes, but also identifies subtle patterns in internet activity.

‘When you do a simple Web search on a topic, the results that pop up aren’t the whole story,’ said Nasa.

The internet contains a vast trove of information – sometimes called the ‘Deep Web’ – that isn’t indexed by search engines: information that would be useful for tracking criminals, terrorist activities, sex trafficking and the spread of diseases.

‘We’re developing next-generation search technologies that understand people, places, things and the connections between them,’ said Chris Mattmann, principal investigator on Memex.

Memex checks not just standard text-based content online but also images, videos, pop-up ads, forms, scripts and other ways information is stored to look at how they are interrelated.
